Limitation of Liability: By entering the Prize Draw you agree to release and hold harmless Tattseal™, Orange County Choppers and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Prize Draw and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any electronic, cable, engine, transmission, tires, brakes, frame, handle bars, rims, exhaust or any other part related to the building of the custom motorcycle.;(iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.   

1. The prize draw (the “Prize Draw”) is open to people who purchase a tube of Tattseal™ and provide their name, address, phone number and email address.
2. Employees or agencies of Tattseal™ or Orange County Choppers or their family members, or anyone else connected with the Prize Draw may not enter the Prize Draw.
3. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.
4. By submitting your personal information you agree to receive emails from Tattseal™ and Orange County Choppers containing offers and developments that we think may interest you. You will be given the opportunity to unsubscribe on every email that we send.
5. If you have any questions about how to enter or in connection with the Prize Draw, please e-mail us at hello@tattseal.com with “Prize Drawing” in the subject line.
6. Each purchase of one retail priced tube of Tattseal™ will count as one Entry. Wholesale entries will count as one entry for every two tubes purchased.
7. Tattseal™ & Orange County Choppers accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered on time for any technical or other reason. 
8. The closing date of the Prize Draw will be after 5,000 tubes of Tattseal are sold, including wholesale sales.
9. One Grand Prize winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions.  If the required quantity of Tattseal™ tubes are sold prior to December 31st, 2019 the draw will be performed at Villain Arts Philadelphia Tattoo Conference in Philadelphia, January 17-19, 2020. If the required number of tubes have not been sold by December 31, 2019, Tattseal™ will select a different show which will be at their discretion, time and place.
10. The winner will receive a custom-made motorcycle from Orange County Choppers.  
11. Tattseal™ and Orange County Choppers accepts no responsibility for any costs associated with the prize and not specifically included in the prize is delivery, taxes or any other costs associated with the winning of the prize.
12. The winner will be announced at the qualifying convention and if the winner is not present, he/she will be notified by email and or phone around two weeks after the prize drawing. If a winner does not respond to Tattseal™ or Orange County Choppers within 14 days of being notified, then the winner’s prize will be forfeited and Tattseal™ shall be entitled to select another winner in accordance with the process described above (and that winner will have to respond to notification of their win within 14 days or else they will also forfeit their prize).  If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner’s prize will be forfeited and Tattseal™ shall be entitled to select another winner.
13. Delivery and taking possession of the prize will be the sole responsibility of the winner.
14. The name and country of the winner can be obtained after the drawing has taken place by sending a stamped addressed envelope to the following address: Tattseal™ Drawing, 101 E. Parke Blvd. #600, Plano, TX 75074
15. The prize is non-exchangeable and is not redeemable for cash or other prizes.
16. The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on or Orange County Choppers reasonable request.  The winner consents to the use by Tattseal™, Orange County Choppers and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner’s voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by Tattseal™, Orange County Choppers and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same.
17. Tattseal™ shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen here, and in accordance with data protection legislation.  By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined in paragraph 14 above.
18. Tattseal™ accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. Tattseal™ and Orange County Choppers further disclaims liability for any injury or damage to you or any other person’s relating to the acceptance and use of the use of the custom motorcycle. Nothing in these Terms and Conditions shall exclude the liability of Tattseal™ or Orange County Choppers for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
19. Tattseal™ and Orange County Choppers reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud or less than 5,000 tubes sold after a one year period). The decision of Tattseal™ and Orange County Choppers in all matters under its control is final and binding and no correspondence will be entered into.
20. Tattseal™ and Orange County Choppers shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
21. The Prize Draw will be governed by American law and entrants to the Prize Draw submit to the exclusive jurisdiction of the American courts.
